Pixel Pearls Terms of Service

Last updated: October 29, 2026

These Terms of Service (“Terms”) are an agreement between you and SecondSurfer LLC (“Pixel Pearls”, “we”, “us”) governing your use of the Pixel Pearls mobile app (the “App”) and pixelpearlsapp.com (the “Website”). By using the App or Website, you agree to these Terms. Our Privacy Policy explains how we handle personal information and forms part of these Terms.

1. Eligibility

The App is intended for use by a Family: an adult Caregiver who creates and owns the Family account, and children whose profiles the Caregiver creates. You must be at least 18 years old, or the age of majority where you live, to create a Family account. A child may use the App only on a device paired by their Caregiver and under that Caregiver's supervision.

By creating a child profile, you represent that you are the parent or legal guardian of that child, or otherwise have authority to act on the child's behalf, and that you consent to the collection and use of that child's information as described in our Privacy Policy. Children are not parties to these Terms; the Caregiver accepts them on the Family's behalf and is responsible for each child's use of the App.

2. Our Service

Pixel Pearls helps a Family turn everyday routines into Quests made of small Steps. A Caregiver creates Quests, sets Pearl values, and curates Rewards. A child marks Steps as Done or skipped, earns Pearls, and works toward Rewards. Caregivers review submitted work where manual approval is enabled and confirm that a Reward has actually been delivered.

Pixel Pearls is a routine-support tool. It is not a medical device, a diagnostic tool, a therapeutic service, or a school behavior-management system, and it does not provide professional advice. It is not a substitute for care from a qualified professional.

3. Family Accounts and Device Pairing

  • The Caregiver who creates the Family account is the Primary Caregiver and is responsible for the account and its child profiles.
  • An Invited Caregiver may share Family administration and approvals if the Primary Caregiver invites them.
  • Each child profile is paired to one active device at a time. Pairing a replacement device invalidates the previous child device session. Pairing uses a QR code scanned on the child's device, with a short numeric PIN as a fallback.
  • You are responsible for keeping your sign-in email secure and for the devices you pair.

4. Subscriptions

Pixel Pearls is offered as a paid Family subscription. The App Store or Google Play shows the current price, any introductory offer, and the renewal and cancellation terms before you subscribe. Subscriptions renew automatically unless cancelled through your store account at least 24 hours before the current period ends. Refunds are handled by the store under its policies. We do not collect or store payment card details.

Deleting the App from a device, or deleting a child profile, does not cancel your subscription. You must cancel through your App Store or Google Play account settings. If you are a consumer in the EU or UK, you may have a statutory right to withdraw from a subscription within 14 days of purchase; where you ask us to begin providing the service immediately, you acknowledge that the withdrawal right ends once the service has been fully performed, and any refund is handled by the store under its policies.

5. Access After Expiry

If a subscription expires, new routine activity pauses, but we preserve your Family's data and earned Pearls so access can be restored. Account and privacy controls remain available. Our Privacy Policy explains how long we keep that data.

6. Pearls and Rewards

  • Pearls are a progress marker inside Pixel Pearls. They have no cash value, are not transferable, and cannot be exchanged for money.
  • Rewards are defined and fulfilled by the Family. Pixel Pearls records the redemption and tracks hand-off; it does not supply, ship, or guarantee any Reward.
  • When a child redeems an affordable Reward, Pearls are deducted immediately. Depending on the approval setting the Caregiver has chosen, the redemption is either approved automatically or held for Caregiver review. If a Caregiver declines the redemption, the Pearls are returned.
  • We may adjust Pearl values or Reward mechanics to correct errors or abuse. We do not remove earned Pearls as a penalty for an interrupted routine.

7. AI-Assisted Content

The App may offer AI-assisted drafting of Quest and Reward content, such as Quest ideas or Step breakdowns. Suggestions are drafts produced with a third-party AI provider (OpenRouter) and its model providers; please do not enter sensitive personal information about a child into free-text fields, as we cannot guarantee redaction of free text. Our agreements with those providers prohibit them from using your inputs to train their models. The Caregiver is responsible for reviewing and editing any generated content before assigning it to a child, and the Caregiver sets Pearl values manually. We do not guarantee that generated content is suitable for a particular child. You may use AI-assisted drafting only if you are the Caregiver for the Family account.

8. Acceptable Use

You agree not to:

  • Use the App to surveil, punish, shame, or coerce a child.
  • Use the App for school behavior administration or as a substitute for professional care.
  • Attempt to access another Family's data, bypass authorization, or probe the service for vulnerabilities without our written permission.
  • Reverse engineer, scrape, or resell the App or Website except as permitted by law.
  • Upload unlawful content or use the service to harass any person.

9. Termination and Suspension

You may stop using the App at any time and may ask us to delete your Family account as described in our Privacy Policy. We may suspend or terminate access to the App or Website if you materially breach these Terms, if we are required to do so by law, or if your use creates a security or legal risk for us or for another Family. Where it is reasonable to do so, we will give you notice and an opportunity to remedy the breach first.

If we terminate your access for a reason other than your breach, we will give you a reasonable opportunity to export the content you created. Termination does not entitle you to a refund except where the app store's policies or mandatory consumer law provide one, and it does not cancel a subscription you bought through an app store.

10. Your Content

You keep ownership of the Quest titles, Steps, Reward names, Reward Details, and other content you create. You grant us a limited licence to store, process, and display that content solely to operate the App for your Family. You are responsible for the content you create and for having the right to create it.

11. Intellectual Property

The App, the Website, the Pixel Pearls name and logo, the pixel-art icon system, and the underlying software are owned by SecondSurfer LLC and protected by intellectual property law. These Terms do not grant you any right to use our branding except as needed to use the App normally.

12. Availability and Changes

We may update, change, or discontinue features. We aim to keep the service available, but we do not guarantee uninterrupted access. Maintenance, network conditions, and app store requirements may affect availability. If we discontinue the service, we will give reasonable notice and a way to export Family data where feasible.

13. Third-Party Services

The App relies on the Apple App Store and Google Play for distribution and billing, and on infrastructure providers for hosting and notifications. Your use of those services is governed by their own terms and privacy policies.

14. No Professional Advice

Pixel Pearls does not provide medical, psychological, educational, or legal advice. Nothing in the App or Website should be relied on as a diagnosis or treatment recommendation. Consult a qualified professional for concerns about a child's development, attention, or behaviour.

15. Disclaimers

The App and Website are provided “as is” and “as available”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law. We do not warrant that use of Pixel Pearls will reduce conflict, improve independence, or produce any particular outcome.

16. Limitation of Liability

To the fullest extent permitted by law, SecondSurfer LLC is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising from your use of the App or Website. Our total liability for any claim relating to the service will not exceed the greater of the amount you paid us for the service in the twelve months before the claim, or one hundred U.S. dollars (USD $100).

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for gross negligence or wilful misconduct, or for any other liability that cannot be excluded or limited by law. If you are a consumer, you keep the benefit of any mandatory right you have under the consumer law of the country where you live, and nothing in these Terms affects those rights.

17. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless SecondSurfer LLC from third-party claims, damages, and reasonable expenses arising from your breach of these Terms, content you create that infringes another person's rights, or your misuse of the App or Website. This section does not apply to the extent a claim results from our own negligence or breach, and it does not apply to consumers in the EU or UK where such an obligation would be unenforceable.

18. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Florida, United States, without regard to its conflict-of-law rules. Subject to the paragraph below, you and we agree that any dispute arising out of or relating to these Terms or the App will be brought exclusively in the state or federal courts located in Broward County, Florida, and you consent to the personal jurisdiction of those courts.

Before filing a formal claim, you agree to contact us and attempt to resolve the dispute informally for at least 30 days. Nothing in this section limits any right you have under mandatory consumer protection law where you live, including any right to bring a claim in your local courts.

19. Changes to These Terms

We may update these Terms as the product changes. If a change materially affects your rights or obligations, we will notify Caregivers in the App or by email before it takes effect, and we will update the “Last updated” date above. Where the law requires it, we will ask you to accept the updated Terms before you continue using the App. Otherwise, continuing to use the App after a change takes effect means you accept the updated Terms.

20. App Store Terms

These Terms are between you and SecondSurfer LLC only, and not with Apple. Apple is not responsible for the App or its content. Your licence to use the App on an Apple device is limited to a non-transferable licence to use the App on any Apple-branded product that you own or control, as permitted by the App Store Terms of Service. Apple has no obligation to provide maintenance or support for the App. If the App fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price, if any; to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App. Apple is not responsible for addressing any claims relating to the App, including product liability, regulatory compliance, or consumer protection claims. Apple is a third-party beneficiary of these Terms and may enforce them against you. You represent that you are not located in a country subject to a U.S. Government embargo and are not listed on any U.S. Government list of prohibited or restricted parties.

21. General

These Terms, together with our Privacy Policy and any terms shown by the app store at purchase, are the entire agreement between you and us about the App and Website. If any provision is found unenforceable, the remaining provisions stay in effect and the unenforceable provision is limited to the minimum extent necessary. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms without our written consent; we may assign them to an affiliate or in connection with a merger, acquisition, or sale of assets. Provisions that by their nature should survive termination, including sections 10, 11, 15, 16, 17, and 18, survive. Neither party is liable for delay or failure to perform caused by events beyond its reasonable control.
